We represent a wide range of financial institutions, including national and regional banks, mezzanine development lenders, and real estate finance entities, in state and federal courts, including bankruptcy courts. The range of matters we have handled for these clients includes lender liability claims, loans and security agreements, alleged ponzi schemes and fraudulent conveyances, and non-judicial foreclosures. We have also assisted our clients with private internal fraud and collusion investigations as well as reviews in the course of regulatory compliance. Our firm also serves as special counsel to state lending institutions and federal regulatory agencies.
Our litigation group has extensive experience working with financial institutions to avoid lender liability claims. In the event such claims are asserted, either as a defense to an action to enforce loan documents or as an independent claim, we work closely with our clients to achieve their goals in the most efficient and cost effective manner possible. We have successfully handled the full range of claims under which lender liability theories can be asserted, including breach of contract, breach of covenant of good faith and fair dealing, negligent or fraudulent misrepresentation, unjust enrichment, wrongful foreclosure, and violation of the Consumer Protection Act.
