Professional Overview

Allyson Bazan is a former assistant attorney general with extensive experience in transactional, regulatory, and litigation matters related to contaminated property and the application of environmental laws such as the Washington Model Toxics Control Act (MTCA) and the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). She specializes in representing clients in real estate transactions and developments involving contaminated property, environmental insurance claims, cost recovery litigation, and allocation of environmental liabilities.

In addition to practicing environmental and natural resource law, Allyson advises on environmental policy development and problem solving for complex projects and regulatory reform.

Representative Matters

  • Assisted a large state agency develop a novel Affordable Housing funding project that targeted private developers and contaminated properties.
  • Advised on and negotiated a multiple party consent decree settlement at a Port-owned upland and sediment cleanup site.
  • Provided critical insight into state funding mechanisms and cleanup policies to support public entity client with PFOA and PFAS remedial activities.
  • Represented a large stage agency during its Washington State Supreme Court appeal involving a case of first impression on coastal zone management.
  • Worked with tribal governments and federal and state agencies at a National Priority List federal cleanup site with emergency removal action to allow for shoreline development by the local government.
  • Legislative and policy support for multiple state agencies, including environmental justice and MTCA reform.
  • Advised the Department of Ecology on enforcing air quality regulations at data centers, including permitting, policy, and defending Ecology’s permit decisions in administrative appeals. 
  • Advised on policy development for siting and regulating renewable energy projects including reclamation and coordination with local government.
